Elon Musk has initiated legal action against the state of New York, challenging the constitutionality of its new anti-hate speech law targeting social media companies. The owner of X, formerly Twitter, is contesting the Stop Hiding Hate Act, also known as Bill S895B, claiming it infringes upon fundamental free speech rights as protected by the First Amendment of the U.S. Constitution.
The law, enacted in December by New York Governor Kathy Hochul, mandates that tech companies publicly disclose their terms of service and regularly report on their efforts to moderate extreme content, hate speech, disinformation, and other harmful materials shared on their platforms. The law recently came into effect, but Musk is disputing its requirements, arguing that they would necessitate X to reveal "highly sensitive information" about its operational practices. He also opposes the potential fines of $15,000 per violation per day.
The legislation was spearheaded by New York State Senator Brad Hoylman-Sigal and State Assemblymember Grace Lee, in partnership with the Anti-Defamation League. Their aim was to hold tech companies more accountable for the problematic content hosted and disseminated on their networks. The lawmakers have dismissed the objections raised in X's lawsuit, characterizing it as an attempt to shield itself from providing transparency to New Yorkers.
Reportedly, Hoylman-Sigal and Lee declined an offer from Musk's company last year to discuss the bill and propose amendments, citing concerns about the company's good faith and potential efforts to weaken the law's provisions. They have emphasized the importance of transparency, particularly in light of the rise in political violence and threats stemming from hate speech and disinformation.
X has also filed a legal challenge against a similar law in California. This approach aligns with Musk's broader efforts to reduce content moderation on X since acquiring the company in 2022. Musk, despite presenting himself as a "free speech absolutist," has a history of using his platform to criticize media outlets that report negatively on his activities.
