Hong Kong Court Overturns Convictions of Tiananmen Vigil Organizers
In a landmark decision, Hong Kong's top court overturned the convictions of three former organizers of an annual vigil commemorating the 1989 Tiananmen Square crackdown. The trio, Chow Hang-tung, Tang Ngok-kwan, and Tsui Hon-kwong, were convicted in 2023 for refusing to provide information to police about their organization's finances and operations.
The court ruled that the prosecution failed to prove the organization was a foreign agent, as they had claimed. The judges also criticized the redaction of crucial details in the case, which they said deprived the defendants of a fair trial.
This ruling marks a rare victory for Hong Kong's pro-democracy movement, which has faced increasing pressure from the Chinese government in recent years. The annual vigil at Victoria Park was the only large-scale public commemoration of the Tiananmen Square crackdown on Chinese soil for decades. However, authorities banned the vigil in 2020, citing anti-pandemic measures.
The court's decision also raises questions about the independence of Hong Kong's judiciary. Several non-permanent overseas judges have quit the top court since the introduction of the national security law in 2020, expressing concerns about the rule of law in the city.
Meanwhile, Chow and two other former alliance leaders, Lee Cheuk-yan and Albert Ho, remain in custody awaiting trial on subversion charges under the national security law. In a separate ruling, the court dismissed jailed pro-democracy activist Tam Tak-chi's bid to overturn his sedition convictions.
These developments highlight the ongoing struggle for democracy and freedom of expression in Hong Kong.
