The Parliamentary Commission of Inquiry (CPI) on Organized Crime in the Brazilian Senate approved on Wednesday, February 25, 2026, the summons of José Carlos Dias Toffoli and José Eugênio Dias Toffoli, brothers of Supreme Court (STF) Justice Dias Toffoli. This decision is part of a broader investigation into alleged financial irregularities and potential connections to criminal organizations, particularly concerning the Banco Master case.
Investigation Focuses on Financial Transactions and Company Links
The CPI's decision to summon Justice Toffoli's brothers stems from their involvement with Maridt Participações, a company they established. Maridt Participações was a partner in the Tayayá Resort, located in Ribeirão Claro, Paraná. The company later sold its stake in the resort to a fund reportedly linked to the brother-in-law of Daniel Vorcaro, the owner of Banco Master.
According to the CPI, the initiative aims to 'identify atypical financial operations, asset concealment structures, and possible connections with criminal organizations.' Senator Alessandro Vieira (MDB-SE), the rapporteur of the CPI, stated that the summons were requested based on 'indications of connection between the involved parties and Reag Trust through corporate participations linked to the Tayayá Resort.'
In addition to the summons, the CPI also approved several other measures:
- The mandatory summons of Daniel Vorcaro, owner of Banco Master, along with other executives associated with the institution.
- The breaking of banking, fiscal, telephone, and telematic secrecy for Banco Master, covering the period from January 1, 2022, to January 29, 2026.
- The breaking of secrecy for Maridt Participações, for the period from February 1, 2022, to February 8, 2026.
- The breaking of secrecy for CBSF Distribuidora de Título e Valores Mobiliários S.A. (formerly Reag), for the same period as Banco Master.
- Invitations for Justice Dias Toffoli and Justice Alexandre de Moraes to provide clarifications to the commission. As these are invitations, their attendance is not mandatory.
- An invitation for Viviane Barci de Moraes, wife of Justice Alexandre de Moraes, to be heard.
STF Ministers Express Reserved Reactions
The decision to summon the brothers of a sitting Supreme Court Justice has elicited reserved reactions within the STF. Internal assessments suggest that the measure may not be directly aligned with the formal scope of the CPI's investigation and could be perceived as an overreach of the commission's authority. Some ministers reportedly view the initiative as unprecedented, particularly concerning the involvement of relatives of STF members.
Justice Toffoli had previously been the rapporteur for a case involving Banco Master within the STF. However, he recused himself from the process on February 12, 2026, with Justice André Mendonça subsequently taking over the rapporteurship. Justice Toffoli has publicly confirmed his partnership in Maridt Participações, stating that he declared all received amounts from the negotiation to the Federal Revenue and denied receiving any funds from Daniel Vorcaro or his brother-in-law, Fabiano Zettel.
