The senators' request, made in a letter to Defense Secretary Pete Hegseth on Thursday, February 5, 2026, stems from allegations that Chinese investors have secretly acquired stakes in the aerospace company, raising significant national security concerns.

The lawmakers expressed concern that such investments could pose 'a national security threat, potentially jeopardizing key military, intelligence, and civilian infrastructure.'

The senators' letter cited media reports and court testimony suggesting that investors with ties to China have routed funds through entities in the Cayman Islands and British Virgin Islands to obscure their purchases of SpaceX shares. One specific instance mentioned involved testimony from SpaceX investor Iqbaljit Kahlon, who reportedly stated in court that channeling Chinese capital through offshore entities would render the risks of foreign investment 'acceptable.'

SpaceX, founded by billionaire Elon Musk, plays a crucial role in U.S. national security infrastructure. The company is responsible for launching military and intelligence satellites and operates its Starlink communications network, which is utilized by the Pentagon and supports Ukraine's defense efforts.

National Security Implications and Regulatory Scrutiny

Senators Warren and Kim emphasized that any Chinese ownership could trigger U.S. rules governing Foreign Ownership, Control or Influence (FOCI), given the potential exposure of sensitive information or technologies.

In their letter, the senators requested the Department of Defense to:

  • Disclose the extent of any Chinese ownership in SpaceX.
  • Assess whether SpaceX is subject to FOCI mitigation requirements.
  • Determine if these foreign investments should be reviewed by the Committee on Foreign Investment in the United States (CFIUS).

The senators have requested a response from Defense Secretary Hegseth by February 20, 2026. The private nature of SpaceX's ownership, coupled with its recent merger with Musk's xAI, valued at an estimated $1.25 trillion, adds complexity to the transparency of its financial backing.
