Spain: Renfe's Punctuality Guarantees Reinstated by Law Amidst Government Opposition

Legislative Mandate for Reinstatement

As of January 1, 2026, a legislative amendment in Spain's Sustainable Mobility Law officially reinstates Renfe's previous punctuality and refund commitments for its high-speed and long-distance train services. Under the reinstated terms, travelers on services such as AVE, Avlo, Alvia, Euromed, and Intercity are entitled to a 50% refund for delays of 15 minutes or more, and a 100% refund if the delay reaches 30 minutes or more.

Background to the Policy Shift

The reintroduction of these guarantees reverses a policy change implemented by Renfe in July 2024. At that time, the state-owned railway operator had adjusted its compensation criteria, reducing refunds to 50% for delays exceeding 60 minutes and 100% for delays over 90 minutes. Renfe stated this modification was aimed at aligning its policies with the newly liberalized Spanish railway market and European regulations, as well as to compete more effectively with private operators like Ouigo and Iryo.

The Legislative Process

The move to reinstate the earlier, more passenger-friendly compensation rules originated from an amendment to the Sustainable Mobility Law. This amendment was proposed by the opposition Partido Popular and garnered significant cross-party support in the Spanish Congress, including votes from Vox, ERC, Junts, PNV, Podemos, and BNG. The legislative approval aimed to restore the level of consumer protection that existed prior to the 2024 changes, which had drawn criticism from consumer platforms and parts of the railway sector.

Renfe and Ministry of Transport's Stance

Despite the legislative mandate, both Renfe and the Ministry of Transport, led by Minister Óscar Puente, have expressed strong opposition to the immediate implementation of the reinstated guarantees. They argue that forcing Renfe to adhere to these stricter compensation thresholds places the public company at a significant competitive disadvantage compared to private operators, who are not bound by the same rules and typically offer compensation only for delays of 60 minutes or more, in line with broader European regulations. Renfe's president, Álvaro Fernández Heredia, has indicated that the company views the clause as 'unconstitutional' and has stated that Renfe will not reinstate the pre-2024 commitment without further regulatory development. The Ministry of Transport has also affirmed that Renfe is not obliged to apply the new norm until the railway sector regulations are modified, and is exploring legal avenues to prevent its full effect. The estimated financial impact of the reinstated payouts could be as high as €125 million annually, potentially leading to fare increases or service cuts.

Uncertainty for Passengers

While the law formally requires the reinstatement of the more generous refund policy, the active resistance from Renfe and the Ministry of Transport creates a period of uncertainty regarding its practical application for passengers from January 1, 2026. The situation highlights a tension between legislative intent to enhance consumer rights and the government's concerns about competitive fairness and the financial sustainability of the state-owned rail operator. Passengers are advised to retain their tickets and monitor official announcements for clarity on how compensation claims will be handled in the interim.
