Mike Stuart Assumes Role as HHS General Counsel

Mike Stuart, a prominent figure with a background as a former State Senator and U.S. Attorney, has officially taken on his new responsibilities as the General Counsel for the Department of Health and Human Services (HHS) within the Trump administration. His nomination was put forth by President Donald Trump in February 2025, and he received confirmation from the U.S. Senate on October 7, 2025, subsequently assuming office on October 9, 2025.

Extensive Legal and Governmental Background

Stuart brings a wealth of experience to his new federal position. Prior to this appointment, he served as the U.S. Attorney for the Southern District of West Virginia, a role he held from January 9, 2018, until February 28, 2021, following his nomination by President Trump. During his tenure as U.S. Attorney, Stuart was recognized for his leadership in federal enforcement, including significant actions across the Appalachian region. His record included prosecuting members of the West Virginia Supreme Court of Appeals, the largest elder fraud takedown, and the largest Medicaid fraud prosecution in West Virginia's history.

Before his federal service, Stuart was active in West Virginia state politics. He was elected to the West Virginia Senate for the 7th district in the 2022 elections and served from 2022 until October 9, 2025, when he resigned to take on his HHS role. In the State Senate, he chaired the Judiciary Committee and focused on issues such as child welfare, foster care reform, substance abuse, and the opioid crisis. Additionally, Stuart chaired the West Virginia Republican Party from 2010 to 2012 and led Trump's 2016 presidential campaign in the state.

Role and Responsibilities at HHS

As the General Counsel for HHS, Stuart will lead the Office of the General Counsel (OGC), which functions as the primary legal team for the department. The OGC is tasked with providing comprehensive legal services and advice to the Secretary of HHS, the Deputy Secretary, and all subordinate organizational components. This includes offering legal guidance on a wide array of national issues, supporting the development and implementation of departmental programs, and providing legal counsel on reproductive health and rights policies and regulations.

Appointment in the Trump Administration

Stuart's appointment is a key development within the Trump administration's second term. He was reportedly ranked as the number-one U.S. Attorney from President Trump's prior administration, which contributed to his selection for this significant role. He is expected to work closely with Robert F. Kennedy Jr., who is awaiting Senate confirmation as the next HHS Secretary.
