Supreme Court Panel Unanimously Affirms Detention
A four-judge panel of Brazil's Supreme Court on Monday, November 24, 2025, unanimously upheld the decision to keep former President Jair Bolsonaro in police custody. The ruling came after Bolsonaro admitted to tampering with his court-mandated electronic ankle monitor. This development marks a significant turn in the legal proceedings against the former leader, who had been under house arrest since August 2025.
The panel, comprising Justices Alexandre de Moraes, Flávio Dino, Cristiano Zanin, and Carmen Lúcia, affirmed the preventive detention order initially issued by Justice de Moraes on Saturday, November 22, 2025. Justice de Moraes cited Bolsonaro's actions as 'serious foul play, repeated non-compliance with precautionary measures and evident disrespect to the court.'
Ankle Monitor Tampering and Flight Risk Concerns
Bolsonaro was taken into custody on Saturday after authorities detected interference with his ankle monitor. He later admitted to using a soldering iron to tamper with the device. This breach of electronic monitoring was a critical factor in the court's decision to convert his house arrest into police custody. Justice de Moraes highlighted 'very serious indications of a possible attempt to flee,' noting a planned vigil by Bolsonaro's son outside his residence and the proximity to the U.S. Embassy, suggesting a potential attempt to seek asylum.
Justice Dino further elaborated on the court's rationale, stating that 'The admitted breach of electronic monitoring not only increases the risk of escape but also indicates a blatant violation of the precautionary measures imposed by the Judiciary.'
Bolsonaro's Defense and Underlying Conviction
In his defense, Bolsonaro claimed that a change in medication for chronic hiccups led to 'hallucinations' and 'paranoia,' causing him to tamper with the ankle monitor. He denied any intention to flee, and in one instance, stated he acted 'out of curiosity' with the soldering iron. However, this explanation was rejected by the justices.
The former president, aged 70, is currently appealing a 27-year and three-month prison sentence he received in September 2025. This sentence was for his role in plotting a coup to overturn the results of the 2022 presidential election, which he lost to Luiz Inácio Lula da Silva. Bolsonaro is being held at the Federal Police headquarters in Brasília.

On one hand, the court must maintain its authority and ensure compliance with its orders, which Bolsonaro clearly violated. On the other hand, the optics of his arrest, especially given his age and former position, will undoubtedly be used by his supporters to fuel claims of political targeting.
