Plea Bargain Recommends 40-Year Sentence
A plea-bargaining agreement has recommended a 40-year jail term for Roderick Cassar in connection with the murder of his estranged wife, Bernice Cilia. The agreement, reached between the defence and the Attorney General's office, is currently awaiting judicial approval in Malta. This development could see Cassar admit to the crime, thereby avoiding a full jury trial.
Details of the Tragic Event and Charges
Bernice Cilia, a 40-year-old mother of two, was fatally shot on November 22, 2022, in the Corradino industrial zone, near the MCAST campus, as she was driving to work. She was shot twice, in the face and breast, at close range. Following the murder, Roderick Cassar fled the scene and barricaded himself inside his home in Qrendi, leading to a 17-hour standoff with police before his eventual arrest.
Cassar faces a total of 15 charges, including murder, unlawful arrest, harassment, threats, stalking, theft of his victim's mobile phone and car keys, using a firearm without a licence, and breaching a probation order. Notably, he was the first person in Malta to be charged under the newly introduced offence of wilful femicide, an aggravated form of homicide. This provision, introduced in June 2022, specifies that the murder of a former spouse is considered a factor 'militating against leniency in punishment'.
History of Domestic Violence and Systemic Failures
The murder of Bernice Cilia brought to light a disturbing history of domestic violence. Cilia had filed multiple police reports against Cassar, with some sources indicating at least five reports, including one just the day before her death. She had an active protection order, which Cassar was accused of breaching. Court evidence revealed that Cilia had confided in relatives about her husband's abusive behaviour, with one incident involving Cassar allegedly holding a knife to her throat in front of their children. On the eve of the murder, she reported a Facebook post by Cassar that stated 'revenge is a must'.
An independent inquiry into the case concluded that the 'state system' had failed Bernice, citing a lack of resources and an increased workload as contributing factors. The inquiry recommended prompt police action when court protection orders are breached and the introduction of electronic tagging, a measure yet to be implemented.
Judicial Review of the Plea Agreement
While Roderick Cassar had initially pleaded not guilty to all charges and challenged various pieces of evidence, including the constitutionality of the femicide law, his defence team initiated discussions for a plea bargain to avoid a jury trial. Under Maltese law, murder typically carries a life sentence. A plea bargain often results in a reduced sentence, commonly by one degree, which in this case translates to the recommended 40-year term.
The final decision on whether to accept the plea agreement rests with Judge Neville Camilleri. Although plea bargains are frequently followed, courts are not legally bound to adhere to the recommended terms, even if they fall within legal parameters. There have been instances where judges have rejected such agreements if they felt the proposed sentence did not adequately reflect the gravity of the charges.
