Lawyers Demand Release, Cite Immigration Policy Violations

Lawyers are calling for the release of an Oregon resident who was apprehended by Border Patrol while fighting a wildfire in Washington State. They argue that his arrest was unlawful, as he was already in the process of obtaining legal status after assisting federal investigators in solving a crime against his family.

The Oregon resident was one of two firefighters arrested this week during the Bear Gulch Fire, the largest wildfire on the Olympic Peninsula since 1951. The lawyers contend that the arrest violated Department of Homeland Security policies, which prohibit immigration enforcement at emergency response locations.

The arrests have sparked public outrage, with Washington Senator Patty Murray criticizing the Trump administration's immigration policies. Since taking office, President Trump has implemented stricter immigration measures, leading to an increase in arrests and growing frustration among ICE agents.

U.S. Customs and Border Protection stated that they were assisting the Bureau of Land Management with a criminal investigation into contractors working at the fire when they discovered two firefighters without permanent legal status. The arrested firefighter, who has lived in the U.S. for 19 years, received a U-Visa certification in 2017 and submitted his application the following year.

The U-Visa program is designed to protect victims of serious crimes who aid federal investigators. The firefighter has been awaiting a decision on his application since 2018. His lawyer argues that his arrest was illegal, citing another Homeland Security policy that protects individuals who have applied for victim-based immigration benefits. The attorney is demanding the firefighter's immediate release, as his whereabouts in the detention system are currently unknown.

The Bureau of Land Management declined to provide information regarding the termination of contracts with two companies and the removal of 42 firefighters from the wildfire. However, a Department of Interior spokesperson stated that they cooperate with other federal agencies, including the Border Patrol.

Senator Ron Wyden has also criticized the Border Patrol's actions, accusing the Trump administration of prioritizing immigration raids over protecting communities from wildfires. He emphasized the risks firefighters face, highlighting the recent death of an Oregon firefighter battling a wildfire in Montana.

Wildfire officials are still working to contain the Bear Gulch Fire, with the number of personnel on the scene decreasing. Senator Murray has accused the Trump administration of undermining the state's ability to combat wildfires, citing the arrests and other policy changes. She emphasized the importance of firefighters in protecting communities and condemned the administration's actions as dangerous and immoral.
