A federal judge has dismissed a lawsuit filed by the Trump administration against all fifteen judges of the Maryland district court. The lawsuit concerned a court policy related to deportation cases. Judge Thomas Cullen, a Trump appointee, criticized the administration's approach, citing judicial immunity and the executive branch's lack of standing to bring the claims.
The policy in question, a standing order, mandated that court clerks in Maryland automatically implement two-business-day pauses in cases involving alleged illegal immigrants challenging their detentions or removals. These pauses temporarily prevented the Department of Homeland Security from deporting or altering an immigrant's legal status until a judge could review the case. Chief Judge George Russell, who issued the order, explained that it was necessary to maintain the status quo amidst an influx of immigration lawsuits, including those filed on weekends and holidays.
Government attorneys argued that the order infringed upon the Department of Homeland Security's authority over immigration policy. They contended that the court lacked the authority to automatically interfere with deportation proceedings. Judge Cullen, presiding over the case due to the Maryland judges' recusal, issued a strongly worded 39-page order.
The judge expressed surprise that the administration chose a confrontational approach rather than challenging the policy on a case-by-case basis, which he deemed the appropriate course of action. He noted that the administration had made a "concerted effort" to damage the judiciary's reputation, particularly as district court judges had often blocked the executive branch's key initiatives, including those related to immigration. Cullen stated that the administration's efforts to smear individual judges were "unprecedented and unfortunate." The Trump administration has appealed Cullen's decision to the U.S. Court of Appeals for the Fourth Circuit.
