A 28-year-old transgender woman from the United States initiated a legal challenge in Amsterdam on Wednesday. She is contesting the rejection of her asylum application in the Netherlands, where she sought refuge, citing safety concerns in her home country.
Veronica Clifford-Carlos, a visual artist from California, sought asylum in the Netherlands, a nation recognized for its early legalization of same-sex marriage and its robust protections for LGBTQ rights. Her legal representatives stated that policies enacted by the Trump administration, specifically those targeting transgender individuals, contributed to her feeling unsafe.
The case, considered a first of its kind in the Netherlands, commenced in an Amsterdam court on Wednesday. A ruling is anticipated within four to six weeks.
President Donald Trump's administration has implemented policies that have limited transgender rights. These actions include executive orders, a ban on transgender individuals serving in the armed forces, and the rescinding of anti-discrimination policies for LGBTQ individuals.
The lawsuit is supported by the Dutch advocacy group LGBT Asylum Support, which is currently assisting approximately 20 U.S. transgender individuals with pending asylum claims.
Data from the Immigration and Naturalisation Service (IND) indicates that 29 Americans applied for asylum in the Netherlands during the first half of this year. This represents a significant increase compared to previous years, where the number of applicants ranged from nine to 18 annually, according to an IND spokesperson.
LGBT Asylum Support released a statement noting that the IND generally recognizes discrimination by authorities and citizens as persecution if it severely impacts a victim's ability to function socially. However, the IND maintains that there are no grounds for exceptional treatment of transgender and queer refugees from the U.S.
