She explained that these devices have a limited recording range, activated by motion, and that systems capturing imagery beyond a private property's boundary are subject to GDPR and data protection regulations.
These regulations include ensuring the camera's use is proportionate, transparent (e.g., through signage), and for a clear purpose. Footage must be stored securely and not retained longer than necessary. The Information Commissioner’s Office (ICO) is responsible for regulating and enforcing these laws.
To address concerns, the expert suggests first speaking with the neighbors to understand the device's recording scope. If this is unsuccessful, a Subject Access Request (SAR) can be submitted in writing to obtain footage involving the individual or their property. A template for this request is available on the ICO’s website, and the neighbor has one month to respond.
If informal resolution fails, a complaint can be filed with the ICO, especially if the neighbor refuses to respond to the SAR or adjust excessive recording. Local councils may also offer assistance with neighbor disputes. If the problem persists, is intrusive, or is used in a harassing manner, seeking legal advice is recommended.
