Legal Guidance on Video Doorbell Recordings and Neighborly Disputes

The increasing popularity of video doorbells has led to concerns about privacy, with some individuals feeling constantly monitored. One person expressed discomfort at being filmed, particularly due to having young children, and the perceived compromise of their privacy. In response, a legal expert has offered guidance on the available options.

Karolina Kupczyk, a partner specializing in dispute resolution, acknowledged the validity of these concerns. She emphasized the importance of balancing security with privacy, stating that individuals have a right to the peaceful enjoyment of their homes, which is protected by law. She explained that these devices have a limited recording range, activated by motion, and that systems capturing imagery beyond a private property's boundary are subject to GDPR and data protection regulations.

These regulations include ensuring the camera's use is proportionate, transparent (e.g., through signage), and for a clear purpose. Footage must be stored securely and not retained longer than necessary. The Information Commissioner’s Office (ICO) is responsible for regulating and enforcing these laws.

To address concerns, the expert suggests first speaking with the neighbors to understand the device's recording scope. If this is unsuccessful, a Subject Access Request (SAR) can be submitted in writing to obtain footage involving the individual or their property. A template for this request is available on the ICO’s website, and the neighbor has one month to respond.

If informal resolution fails, a complaint can be filed with the ICO, especially if the neighbor refuses to respond to the SAR or adjust excessive recording. Local councils may also offer assistance with neighbor disputes. If the problem persists, is intrusive, or is used in a harassing manner, seeking legal advice is recommended.

I'm skeptical about the 'clear purpose' requirement actually being followed. Often its for petty security reasons.

Sure, a 'limited range' is the claim, but how many are actually set up responsibly? I bet very few are properly signed or managed.

I use clear signage. It is the right thing to do, and makes neighbors feel more at ease.

The article's suggestion of contacting the ICO if an issue persists is definitely needed and valuable.
