A US appeals court has permitted President Donald Trump to continue deploying National Guard troops in Los Angeles. This decision came amidst protests related to increased immigration enforcement. The court's action temporarily suspended a previous ruling from a lower court that had blocked the mobilization.
The 9th US Circuit Court of Appeals' ruling does not indicate a final agreement with Trump's actions. However, it ensures that the president retains command of the National Guard for the time being.
Earlier in the day, US District Judge Charles Breyer, based in San Francisco, had declared Trump's deployment of the Guard unlawful. Judge Breyer had ordered the National Guard to be returned to the control of California Governor Gavin Newsom, who initiated the legal challenge. This victory for Newsom was short-lived, as the order was quickly paused.
The appeals court panel, comprised of two judges appointed by Trump and one appointed by President Joe Biden, decided to hold a hearing next Tuesday to review the merits of Judge Breyer's order.
The appeals court's decision maintains the existing situation of street demonstrations in downtown Los Angeles. These protests have primarily focused on a federal detention center where National Guard troops have been stationed. The Guard had also been involved in operations alongside Immigration and Customs Enforcement agents.
Judge Breyer's ruling stated that the presence of the troops was escalating tensions with protesters, a view shared by Los Angeles Mayor Karen Bass. The judge also argued that the deployment was preventing the state from utilizing the Guard for other purposes.
