Officer Cleared of Murder Faces Misconduct Hearing Over Fatal Shooting

An armed Scotland Yard officer, previously cleared of murdering a violent gangster in south London, now faces a gross misconduct disciplinary hearing. The officer, Sergeant Martyn Blake, is accused of gross misconduct related to the shooting and could potentially be dismissed from his position. The Independent Office for Police Conduct (IOPC) initiated the review and subsequent hearing.

The incident involved the shooting death of Chris Kaba in Streatham in September 2022. Kaba, driving a vehicle, allegedly attempted to break through a police roadblock, prompting Sergeant Blake to open fire to protect his colleagues. Following an IOPC investigation, Sergeant Blake was charged with murder. However, a jury at the Old Bailey found him not guilty after a trial in October of the previous year.

Despite the acquittal and reinstatement to his post, the officer now faces potential disciplinary action. The Metropolitan Police Federation has criticized the IOPC's decision, arguing that it puts officers' livelihoods at risk for performing their lawful duties. The Federation has vowed to defend Sergeant Blake's actions and support officers who carry firearms.

Following the acquittal, the Met Commissioner expressed concern that charging officers in such situations could undermine morale and make London less safe. The officer, known as NX121, had made significant sacrifices and acted with professionalism. However, the disciplinary process is based on a civil test, which requires an honest but reasonable belief.

The victim, Kaba, was associated with a violent gang and had a history of gun-related offenses. On the evening of the shooting, armed police were following Kaba's vehicle. When officers attempted to stop the car, Kaba accelerated towards them, leading to the fatal shooting by Sergeant Blake.

Prosecutors suggested the officer acted out of negative emotions, but the jury accepted the officer's explanation that he acted in accordance with his training, believing his colleagues were in danger. The case sparked controversy within armed policing, with some officers considering handing in their weapons. The Home Secretary announced a change in the law to protect the anonymity of firearms officers charged with murder in the line of duty, unless convicted.

The decision to pursue disciplinary action against Sergeant Blake is expected to further impact the confidence of his armed colleagues. The Met Police is expected to challenge the decision legally. The Assistant Commissioner acknowledged the impact of Kaba's death on his family and stated that the force had argued against further action due to the court's verdict. The Met recognizes the importance of the officer's right to an impartial hearing. A chief officer from another police force will chair the hearing to ensure impartiality.
