Prosecutor Shannon Lucey presented Weinstein as someone who leveraged his position in Hollywood to exploit and sexually abuse women. She argued that he maintained their silence by controlling their careers. Lucey emphasized Weinstein's power in the industry, stating he decided who would succeed.

A new charge of assault against another woman in Manhattan in 2006 has been added. The woman is Kaja Sokola, who claims Weinstein assaulted her when she was a 16-year-old aspiring actress.
Even if acquitted, Weinstein faces a likely life sentence due to a sex crime conviction in California. Weinstein has experienced health issues while incarcerated, and his lawyers are seeking permission for him to stay overnight at a hospital during the trial. His representatives have also stated he has received inadequate medical care.
