Illegal Practices Impact Adelaide City Council Election Results, Judge Finds

A 2022 election for Adelaide City Council's Central Ward has been marred by identified "illegal practices," according to a District Court judge. The decision, delivered by Judge Michael Burnett, confirmed allegations originally made by former councillor Alex Hyde, who lost narrowly to incumbent Jing Li by just 24 votes. Hyde questioned the integrity of the election and approached the court in December 2022, asserting that activities violating election law had taken place, particularly illegal handling of postal ballot papers.

Following the election results, significant concerns were raised about the legitimacy of certain ballots when the Electoral Commissioner announced an investigation into claims that unauthorised individuals collected ballot papers within some apartment complexes. While examining the accusations, Judge Burnett determined that at least 16 ballots had indeed been filled out by persons other than those to whom they had been issued, thereby constituting illegal practices capable of influencing the election outcome.

During proceedings, photographic evidence was presented that showed two individuals improperly handling ballot papers outside the Vision on Morphett apartment building, as well as at the Stonemill Restaurant nearby. Another individual was also shown to have retrieved unfilled ballot papers from apartment units, reinforcing the claims made against Li's representatives. However, an allegation of bribery levelled directly against Li was dismissed by the court.

Although the judgement authenticated some of Hyde's serious claims, Judge Burnett did not immediately overturn the election results but indicated that the court retains the authority to make wider declarations. Both Hyde and Councillor Li will have the opportunity to submit further arguments concerning possible additional outcomes or court orders.

Adelaide Lord Mayor Jane Lomax-Smith acknowledged the court's decision, urging patience until the court specifies its order. She provided assurances that council functions and community services would remain unaffected while awaiting final clarity on the matter.

Alex Hyde welcomed the ruling, highlighting its broader implications about electoral processes and democracy in Australia. Councillor Li refrained from making extensive remarks, noting only that the matter was ongoing and further submissions would be made before final orders are decided.
