Proposed Changes to Abortion Laws in New South Wales

A significant overhaul of New South Wales's abortion laws is being proposed, which would make it mandatory for most of the state's hospitals to offer abortion services. Currently, under the NSW Health directive, hospitals are not obligated to provide abortions and are only required to offer "referral pathways" to ensure women have access to care.

Greens MLC Amanda Cohn has proposed an amendment to the Abortion Law Reform Act 2019, which would require NSW Health to provide abortions at most hospitals and health services. This would not force every smaller health facility to offer the care, but rather the state's local health districts (LHDs) would have to ensure it was accessible within a reasonable distance.

Dr. Cohn argues that the current system is failing women, as they are often turned away from public hospitals seeking abortion services. She believes that access to abortion should be legislated and not left to the discretion of individual hospitals.

The proposed amendment would also remove the requirement for doctors to report a termination within 28 days to the secretary of the Ministry of Health. Dr. Cohn argues that this reporting requirement is unnecessary and can be a barrier for some health practitioners wanting to become abortion providers.

Independent MP for Orange Phil Donato has expressed support for the proposed amendment, stating that he would be comfortable supporting it if it passed the NSW upper house and reached the lower house.

The proposed changes have been met with mixed reactions. Some argue that they are necessary to ensure women have access to safe and timely abortion services, while others believe that they go too far and could lead to an increase in abortions. The debate is likely to continue as the proposed amendment makes its way through the NSW Parliament.
