DWP to Compensate Thousands of Benefit Claimants Following Court Battles
The Department for Work and Pensions (DWP) has announced a compensation scheme for tens of thousands of benefit claimants who lost out financially after transitioning from legacy benefits to Universal Credit. The scheme follows two High Court rulings in 2018 and 2019 that found the government failed to adequately protect the benefit payments of these claimants, resulting in a monthly income loss of around £180.
The compensation will be paid to approximately 57,000 individuals who were receiving certain disability benefits and lost their Severe Disability Premiums (SDP) during the transition. The DWP aims to complete the scheme by August 2023, with payments potentially reaching £5,000 per person.
The scheme was announced after the DWP settled a case brought by law firm Leigh Day on behalf of 275 claimants. Leigh Day partner Ryan Bradshaw expressed disappointment that it took six years for the DWP to address the issue, highlighting the negative impact on many disabled individuals. He emphasized the need for the DWP to ensure that disability premiums are maintained and that no one is worse off on Universal Credit.
Group 1: Around 35,000 individuals with the simplest cases, where payments can be made automatically through the digital system.
15,000 individuals with mixed clerical and digital records, requiring the DWP to find a solution for addressing their cases.
7,000 individuals with mixed clerical and digital records, similar to Group 2.
The DWP hopes to complete the compensation scheme by August 2023, providing much-needed financial support to those who were negatively impacted by the transition to Universal Credit.
