The Need for a Strong Legal Framework for Racial Harmony
In response to public concerns that the proposed Bill only prevents racial disharmony without actively promoting it, Mr Shanmugam acknowledged the desire for a more proactive approach. However, he emphasized the limitations of legal enforcement in fostering genuine harmony.
"Laws provide a very strong legal framework and can be enforced against people, hence reducing and deterring bad behaviour," he explained. "They are usually necessary only for a small minority of people."
Instead, Mr Shanmugam advocated for a multi-pronged approach that combines a robust legal framework with societal initiatives. He cited the Maintenance of Religious Harmony Act as an example, highlighting its effectiveness despite the lack of its use.
"We have had similar powers for over 30 years, and the powers have never been used. That gives you an indication of how the government approaches these powers," he said.
He emphasized the importance of a cautious and judicious approach to the use of restraining orders, outlining the safeguards in place. These include the involvement of the Minister for Home Affairs, the presidential council, and the president, ensuring public accountability and a thorough review process.

Mr Shanmugam addressed concerns about the Act potentially stifling race-related discussions and the possibility of disproportionate use of restraining orders by the authorities. He emphasized the importance of striking a balance between promoting open dialogue and preventing harmful speech.
"The Bill … will not be a panacea for solving all race-related challenges, but it is a powerful signal of our resolve to remain united as one people," he concluded.
