In a shocking display of misconduct, 63-year-old David Misch was expelled from a California courtroom when he started singing "99 Bottles of Beer" during his sentencing hearing for the murders of two young women. Misch had been found guilty in December for the murders of Jennifer Duey, aged 20, and Michelle Xavier, aged 18, which occurred in 1986.
During the hearing, Misch was issued two consecutive 25-to-life sentences; however, he did not remain present for the proceedings. Instead, he was removed for his outburst, which occurred while the victims' families were delivering impact statements. Reports indicate that even after being taken out, he continued to whistle the same song from an adjacent holding cell, further demonstrating a lack of remorse.
According to the Chief Assistant District Attorney, Misch’s behavior exemplified a complete disregard for the gravity of his actions and the pain inflicted on the victims’ families. The evidence presented during his trial included DNA found under Duey's nails, which was linked to Misch, along with a partial license plate number written by one of the victims, connecting him to his previous criminal history.
The discovery of Duey and Xavier's bodies near a road in Fremont in February 1986 and the subsequent investigation led to Misch's arrest in 2018 for this long-unsolved case. Misch has a prior conviction for a homicide in 1989 and is also awaiting trial for the murder of a 9-year-old girl, Michaela Garecht, who was abducted in 1988.
