Eduardo Valdivia, a special agent at the FBI, has been charged with assaulting two women, as documented in police reports and court records. This situation arises after he was previously acquitted of attempted murder stemming from a shooting incident on a Metro subway train near Washington, D.C. four years ago. Following his arrest in Maryland on Monday, Valdivia is currently on suspension from his duties at the Bureau, while the Montgomery County police carry out their investigation.
In response to the allegations, the FBI released a statement emphasizing their seriousness towards criminal conduct and confirmed their cooperation with local police. The Bureau refrained from providing additional comments, citing the ongoing nature of the investigation. Valdivia had previously faced legal issues for an off-duty shooting in 2020, where he was accused of second-degree murder, but was found not guilty after claiming self-defense during a confrontation on a moving train. The agent had been working with the FBI since 2011 and was promoted to a supervisory position in 2019.
Valdivia is now facing felony and misdemeanor charges related to sexual offenses, including two counts of second-degree rape, which allegedly occurred in 2024. His defense attorney, Robert Bonsib, has stated that they do not accept the allegations without reviewing all the evidence. The Montgomery County Police Department continues to investigate, anticipating further victims to come forward. Valdivia is currently held in custody and is set for a bond hearing soon.
