David Hosier, a 69-year-old death row inmate in Missouri, is scheduled to be executed on Tuesday evening. Hosier has long maintained his innocence in the murders of Angela and Rodney Gilpin in 2009.
Hosier's legal team filed a clemency petition on his behalf, citing childhood trauma from the murder of his own father as a mitigating factor. However, Hosier disagreed with this approach and wanted his lawyers to focus on the lack of DNA evidence at the crime scene.
Prosecutors allege that Hosier, who was having an affair with Angela Gilpin, killed her and her husband out of revenge after she ended their relationship. Hosier was arrested in Oklahoma, where law enforcement recovered firearms, ammunition, a bulletproof vest, and a knife from his car. Prosecutors also presented a note found in Hosier's car that they claim is incriminating.
Hosier maintains his innocence, claiming that he was not fleeing to Oklahoma but was taking a long drive to clear his mind. He also stated that he often carried his guns for hunting and protection. Hosier rejected a plea deal that would have taken capital punishment off the table if he admitted guilt.
Missouri Governor Mike Parson rejected Hosier's clemency petition and declined a request from Representatives Cori Bush and Emmanuel Cleaver to stop the execution. In a statement, Parson said that Hosier "earned maximum punishment under the law."
Hosier, who has been diagnosed with atrial fibrillation, expressed his continued belief in his innocence in a recent interview. "I will maintain that till the day they stick a needle in my arm and kill me," he said. "I'll still be innocent, even though I'm dead.
